Problem in Photoshop CC and not in CS6

Hi everyone,

If I have two folders in Photoshop CC and one is invisible and the other isn't, when I drag a box around layers in the workspace it chooses levels from that invisible directory as well, this only happens in CC not CS6 I tried. I am having to go through each part and secure it so it will never get chosen.
